Terms of Service
The agreement between you and MyDanceDates for using the app, the website, and our mobile apps.
1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Lucky Dog Brands LLC (“MyDanceDates”, “we”, “us”). They cover your use of MyDanceDates: the app at mydancedates.com, our mobile apps, this website, and any emails or calendar feeds we provide (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use MyDanceDates
You must be at least 13 years old to use MyDanceDates. If you're under 18, you need a parent or guardian's permission, and they agree to these Terms on your behalf. You can't use the Service if the law forbids you from doing so.
3. Your account
Give us accurate information when you sign up and keep it up to date. You're responsible for what happens under your account, so keep your sign-in method secure. If you think someone else has gotten into your account, contact us right away at support@mydancedates.com.
4. What MyDanceDates is, and what it isn't
MyDanceDates is an organizing tool. It collects publicly posted audition information, helps you decide what to pursue, and tracks your progress. We are not a casting service, talent agency, employer or union. We don't submit applications for you, we don't represent you to any company, and we can't promise you'll get an audition, a callback or a job.
5. Audition information
The audition information in MyDanceDates comes from third parties, usually public audition boards and company websites, and is read partly by automated tools. It may be incomplete, out of date or wrong. Dates move, details change, and listings disappear. Always confirm the details with the organizer, using the original listing, before you rely on them. We don't check, vouch for or endorse any company, production or person listed, and we aren't responsible for what they do.
Be careful with any listing that asks you to pay a fee, wire money, or send sensitive personal information. If something looks like a scam, please tell us so we can take it down. Listings, flyers, names and logos belong to their owners. We show the facts and link to the original.
6. Your content
The things you add to MyDanceDates, such as your resume, headshots, links, notes and templates (“Your Content”), belong to you. You give us a limited permission to store, copy, process and show Your Content back to you, only so we can run the Service for you. That permission ends when you delete the content or your account, except for backup copies, which are removed on their regular schedule.
If you share a file by link, anyone who has the link can open it until you stop sharing it, so send it only to people you mean to. You can stop sharing at any time in the app.
You're responsible for Your Content, and you confirm you have the right to upload it. For example, make sure your headshot photographer's license lets you use the photo this way. Don't upload anything that's illegal or that infringes someone else's rights.
7. Acceptable use
Please don't:
- use the Service for anything illegal, or to harass, deceive or harm anyone;
- pretend to be someone else, or misrepresent who you are to an organizer;
- scrape, copy or resell audition data from the Service, or use automated means to access it outside our features;
- try to get into accounts, files or systems that aren't yours, or probe, test or break our security;
- upload viruses or other harmful code, or interfere with how the Service runs;
- reverse engineer the Service, except where the law clearly allows it.
8. Your calendar link
Your calendar feed lives at a private web address. Anyone who has that address can see the auditions and deadlines in the feed, so keep it to yourself. If you think it's been shared, contact us and we'll replace it.
9. Price
MyDanceDates is free during early access. If we ever add paid features, we'll tell you the price and the terms ahead of time, and you'll only be charged if you choose to sign up for them.
10. Other services
MyDanceDates works with other companies' services, like Sign in with Apple, Sign in with Google, calendar apps, your email app, and the websites where auditions are posted. Your use of those services is covered by their own terms and privacy policies, and we aren't responsible for them.
11. If you got our app from the App Store or Google Play
If you downloaded MyDanceDates from Apple's App Store or Google Play, you also agree to the following:
- These Terms are between you and us, not Apple or Google. We, not Apple or Google, are solely responsible for the app and its content.
- Your license to use the app is limited to devices you own or control, as allowed by the store's usage rules.
- Apple and Google have no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If anyone claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
- You confirm that you aren't located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you aren't on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce these Terms against you as a third-party beneficiary.
12. Our property
The MyDanceDates name, logo, software, design and written content belong to Lucky Dog Brands LLC. As long as you follow these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own auditions. If you send us ideas or feedback, we're free to use them, and we don't owe you anything for them.
13. Ending your use
You can stop using MyDanceDates at any time, and you can ask us to delete your account as described in our Privacy Policy. We may suspend or close an account that breaks these Terms or puts other people or the Service at risk. Where it's reasonable, we'll warn you first. We may also change or discontinue features. If we ever shut down the Service entirely, we'll give you notice and a chance to download your information first. Sections 5, 6, 12, 14, 15, 16 and 17 survive after your use ends.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AUDITION INFORMATION WILL BE COMPLETE, CURRENT OR CORRECT.
15. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, MYDANCEDATES AND LUCKY DOG BRANDS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST OPPORTUNITIES, MISSED AUDITIONS OR DEADLINES, LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF US$50 OR WHAT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not all apply to you.
16. Indemnity
If someone brings a claim against us because of Your Content or because you broke these Terms, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
17. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York County, New York, and you and we both agree to their jurisdiction. If you live in a country whose consumer protection laws give you the right to bring a claim in your own courts, nothing here takes that right away.
18. Changes to these Terms
We may update these Terms. We'll post the new version here and update the date at the top. If a change is material, we'll tell you by email or in the app before it takes effect. If you keep using MyDanceDates after that, you're agreeing to the new Terms.
19. Everything else
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If a court finds any part of them unenforceable, the rest still applies. If we don't enforce a provision right away, we haven't given up the right to enforce it later. You can't transfer these Terms to anyone else; we may transfer them as part of a merger, acquisition or sale of the Service.
